Robinson, who is 23 years old, is accused of killing Kirk in September. According to the reporting, he faces multiple charges in the case, including aggravated murder, use of a firearm and witness tampering. At the center of Monday's hearing was an effort by Robinson's attorneys to block certain hearsay evidence. The material they sought to exclude included pre-recorded testimony from Robinson's roommate and former lover, Lance Twiggs, as well as the medical examiner's report and federal DNA and ballistics reports.

The judge ultimately handed down a split decision on that request. While prosecutors cannot compel Twiggs to take the stand and testify, the court ruled that they are allowed to play his recordings in court. Judge Tony Graff also addressed a separate and potentially consequential issue, delaying his ruling on a possible gag-order violation. According to the account, that question could ultimately lead to the removal of the death penalty in the case, making it one of the more closely followed elements of the proceedings.
